المصدر 24 - أقر البرلمان الألماني (البوندستاغ) في جلسة ليلية استمرت حتى ساعات الفجر أمس (الخميس) مشروع قانون يحظر بيع أكسيد النيتروز، المعروف بـ«غاز الضحك»، للقاصرين دون سن 18 عاماً، ويمنع تداوله عبر الإنترنت أو من خلال آلات البيع الذاتية، في خطوة تهدف إلى مكافحة إساءة استخدامه كمخدر ترفيهي بين الشباب.
وهو غاز عديم اللون يُستخدم طبياً كمسكن للألم ومخدر خفيف، وصناعياً في إنتاج الكريمة المخفوقة، لكنه أصبح في السنوات الأخيرة مخدراً ترفيهياً شائعاً بين الشباب والمراهقين في ألمانيا وأوروبا، حيث يُباع في خراطيش صغيرة عبر الإنترنت أو آلات البيع الذاتية، ويُستنشق عبر بالونات لإحداث تأثير إيحائي سريع.
ويحمل مخاطر صحية خطيرة، بما في ذلك الدوخة، الإغماء، الهلوسة، وأضرار دائمة في الجهاز العصبي، مع ارتفاع حالات التسمم المسجلة بنسبة ملحوظة في السنوات الأخيرة، خصوصاً بين القاصرين.
ونقلت وسائل إعلام ألمانية عن مصادر برلمانية أن القانون الجديد، الذي صدر كتعديل على قانون المواد النفسية الجديدة، يصنف الغاز مادة نفسية جديدة محظورة للاستخدام الترفيهي، مع حظر صريح على شرائه أو حيازته من قبل القاصرين، إضافة إلى منع توزيعه عبر البريد أو الآلات الآلية لضمان التحقق من العمر.
ويسمح القانون باستثناءات محدودة للبالغين، حيث يُبقي على بيع الخراطيش الصغيرة بحجم يصل إلى 8.4 غرام لأغراض صناعية أو غذائية، مثل تحضير الكريمة المخفوقة، لتجنب تعطيل الاستخدامات الشرعية.
وجاء هذا القرار بعد نقاشات حادة في الجلسة الليلية، حيث حذر النائب المحافظ هانز ثيس من أن الغاز «شيطاني» على الشباب، مشيراً إلى ارتفاع حالات التسمم والأضرار العصبية الدائمة المرتبطة به، خصوصاً مع سهولة الحصول عليه سابقاً عبر المتاجر الليلية أو الإنترنت.
ودعم المشروع وزير الصحة الاتحادي، الذي أكد أن «غاز الضحك ليس مزحة بريئة»، معتبراً الحظر ضرورياً للحماية الصحية العامة في ظل الانتشار المتزايد بين المراهقين.
ويُعد هذا التشريع تتويجاً لجهود حكومية بدأت في يوليو 2025، بعد الانتخابات المبكرة في فبراير، ويأتي في وقت شهدت فيه المدن الألمانية حظراً محلياً مؤقتاً للغاز، ما يعزز الجهود الوطنية لمكافحة المخدرات الجديدة مثل «قطرات الإسقاط» أيضاً.
ومن المتوقع أن يدخل القانون حيز التنفيذ قريباً، مع غرامات تصل إلى آلاف اليورو على المخالفين، وسط ترحيب من خبراء الصحة وانتقادات من بعض التجار الذين يخشون تأثيراً على المبيعات الشرعية.
The German parliament (Bundestag) approved a bill in a late-night session that lasted until the early hours of yesterday (Thursday) prohibiting the sale of nitrous oxide, known as "laughing gas," to minors under the age of 18, and banning its distribution online or through vending machines, in a move aimed at combating its misuse as a recreational drug among youth.
It is a colorless gas used medically as a pain reliever and mild anesthetic, and industrially in the production of whipped cream, but it has become a popular recreational drug among young people and teenagers in Germany and Europe in recent years, where it is sold in small cartridges online or through vending machines, and inhaled through balloons to produce a rapid euphoric effect.
It carries serious health risks, including dizziness, fainting, hallucinations, and permanent damage to the nervous system, with a notable increase in recorded cases of poisoning in recent years, particularly among minors.
German media reported from parliamentary sources that the new law, which was issued as an amendment to the new psychoactive substances law, classifies the gas as a prohibited new psychoactive substance for recreational use, with an explicit ban on its purchase or possession by minors, in addition to prohibiting its distribution via mail or automated machines to ensure age verification.
The law allows for limited exceptions for adults, as it maintains the sale of small cartridges weighing up to 8.4 grams for industrial or food purposes, such as preparing whipped cream, to avoid disrupting legitimate uses.
This decision came after heated discussions in the late-night session, where conservative MP Hans Thies warned that the gas is "demonic" to youth, pointing to the rise in poisoning cases and permanent neurological damage associated with it, especially with its previous easy availability through night shops or online.
The bill was supported by the federal health minister, who stated that "laughing gas is not an innocent joke," considering the ban necessary for public health protection in light of its increasing prevalence among teenagers.
This legislation marks the culmination of government efforts that began in July 2025, following early elections in February, and comes at a time when German cities have imposed temporary local bans on the gas, reinforcing national efforts to combat new drugs such as "dropper liquids" as well.
The law is expected to come into effect soon, with fines reaching thousands of euros for violators, amid support from health experts and criticism from some traders who fear an impact on legitimate sales.
